Accused loses appeal in ‘sexomnia’ case, victim feels justice finally served

A man who sexually assaulted Bekah D'Aoust at a house party in 2011, but claimed that he was asleep during the assault, will have to serve his time after all.

Ryan Hartman was sentenced to a year in prison for sexual assault back in March of 2019. The 38-year-old was also set to spend three years on probation and a decade on the sex offender registry after being found guilty of sexually assaulting D'Aoust.

In February of 2019, Hartman launched a “Jordan” appeal; arguing that his conviction should be tossed out because his right to a trial within a reasonable timeframe was violated. The judge in the case waved that appeal.

Hartman then obtained a new lawyer and appealed the judge's decision to toss out his Jordan appeal.

That appeal was lost on Tuesday, January 7, 2020.

D'Aoust requested a publication ban on her name be lifted in early March, with the hope that her case would give other sexual assault victims the courage to come forward.
