Integrity commissioner terminates inquiry into Coun. Tim Tierney’s memo leak

The integrity commissioner has terminated its inquiry into Coun. Tim Tierney after the councillor had identified himself as the source of the leak of a confidential memo detailing an insurance claim into LRT Stage 1.

The commissioner announced the termination via memo to members of council on Friday, saying that council had accepted the councillor’s apology for the leak.

“Under the Complaint Protocol, I have the discretion to terminate an inquiry if, during the course of an investigation, it becomes apparent that there are no grounds or insufficient grounds to continue with an investigation,” Robert Marleau, the commissioner, wrote in his memo.

“Councillor Tierney has admitted to the breach of the Code of Conduct for members of council, apologized for his mistake, and committed to upholding Council’s confidentiality obligations in the future. By way of motion, Council has unanimously accepted the Councillor’s apology.”

On May 26, city council formally requested an investigation into the alleged leak of the confidential memo sent from city staff and external legal counsel on May 10.

On June 9 during the city council meeting, Tierney identified himself as the leak.

He admitted to inadvertently including the confidential memo with some other documents he sent to a journalist about an unrelated public issue.

After issuing a notice of inquiry to all of city council, Marleau started his investigation.

As a result of what his findings, Marleau has terminated the investigation and the matter is now closed.
